Terms and conditions

Benitravel acts as an agent on behalf of accommodation / transfer and additional services provider unless otherwise indicated.

Please read the booking terms and conditions carefully, they apply to all bookings made with Benitravel and each individual member of your party.

1.      Your Contract

When you book accommodation either via the internet or telephone, your booking is confirmed immediately and it is at this time a binding contract comes into existence, email confirmation of your booking will also be sent to you and a voucher will follow once full payment has been taken.

The contract is subject to these booking terms and conditions, all booking conditions will apply to each and every booking made with Benitravel.

Once the contract is made, it is the accommodation providers' responsibility to provide you with what you have booked and it is your responsibility to pay for the service in full at booking or with the chosen option of a 30 % deposit against a 5 % surcharge of the total amount, the remaining amount is dued 90 days before arrival day.

All relevant documentation will be sent to you via email with exception of the voucher which may be sent by regular mail, it is important to check carefully all the details of your booking once you receive it. Benitravel will not be responsible for any information you do not receive, as a result of your failure to provide a valid (e-mail) address.

If you want to cancel or amend your booking later, you may have to pay cancellation or amendment fees.

2.      Pricing

Prices are quoted in EURO. We reserve the right to change prices at any time before you book.

Payment is required at the time of booking unless agreed otherwise by both parties.

3.      Our Price Guarantee

We do change prices from time to time. Prices can go down as well as up.

We guarantee that once you have made your booking we will not increase the price of your accommodation - this includes any changes to VAT or Government Taxes.

Please note once you have agreed a price and made your booking this is the price you pay. If the price decreases, you are not entitled to the service at the changed rate.

4.      Cancellation and Refund Policy

In the event you wish to cancel your arrangements we require written confirmation from the person who made the booking. Charges are based on the total cost of the booking and are as follows:

5.      If We Change Your Booking

In some instances Benitravel may alter or cancel your accommodation, in such circumstances we will inform you immediately and will do our utmost to provide you with an alternative accommodation.

Please note neither Benitravel nor the accommodation provider are responsible for any additional costs incurred as a result of this, nor will they be obliged to pay compensation.

6.      Our Responsibility

As Benitravel is acting only as a booking agent we have no liability for any of the arrangements and in particular any liability for any illness, personal injury, death or loss of any kind, unless caused by our negligence.

Any claim for damages for injury, illness or death arising from your stay must be brought against the accommodation provider and will be under the jurisdiction of the Spanish law.

7.      Your Responsibility

Benitravel does not accept responsibility for services not received as a result of incorrect information provided at the time of booking.

Accommodations are cleaned prior to arrival and it is your responsibility to leave the rented accommodation in the same situation as you have found it, any damages are to be notified to the accommodation provider.

It is also your responsibility to have valid travel documents. If we or your accommodation provider are fined as a result of you holding incorrect documents, we will ask you to pay this amount.

It is a condition of booking with us that you also have sufficient travel insurance for your reservation.

8.      If I Want to Change My Booking

If you want to change any of the details of your booking after we have sent you confirmation, we at Benitravel will do our best to help. Any changes must be made in writing to our office.

If we are able to make the change there will be a charge as shown on the scale below added to the corresponding rate of the adjusted booking.

Modification Charges

For modifications completed by e-mail 7 days or more prior to booked arrival date

10 EURO per booking

For modifications completed by e-mail 7 days or less prior to booked arrival date. Within 7 days of arrival such amendments will reflect the charges made by the accommodation providers.

minimum

15 EURO per booking

Fees for amendments made to the time of your arrival or lead name will also reflect those of the accommodation provider. We will not add a mark up to this amount.

 

9.      Late Arrivals

Please be aware that it is your responsibility to make the accommodation provider aware of any delays in your arrival time by calling the indicated phone number on the voucher; it is not always possible to predict and/ or obtain information with regard to such instances. As a result neither Benitravel nor a accommodation provider accepts responsibility for missed services due to delayed, postponed, or other problems regarding your arrival time.

10.  Misbehaviour

We reserve the right to terminate without notice the arrangements of any customer whose behaviour, in our opinion, is likely to cause annoyance, distress or danger to other customers or any third party. Full charges will apply and we will be under no obligation to provide a refund, compensation, or any further assistance.

11.  Indemnity

When you book a service through Benitravel you accept responsibility for any damage to the accommodation caused by you or a member of your party. A deposit is required at check in and shall be returned at check out after inventory is verified.

Benitravel and the accommodation provider reserves the right to terminate the service booked or that of any member of your party due to your or their misconduct, within their reasonable opinion.

In these circumstances full charges will then apply and no refund will be given. Furthermore, Benitravel and the accommodation provider shall be under no obligation to pay compensation or meet any costs or expenses you may incur as a result of the service being terminated.

You agree to indemnify us against any claims (including legal costs) made against us or on behalf of the accommodation provider. Finally you are also liable to make a reimbursement to the accommodation provider for any damage caused, before you return home.

12.  Disputes

In the event of any dispute our liability shall not exceed the charge for the service provided. Any litigation will be subject to the Spanish Law.

13.  Complaints Procedure

If you experience problems with your accommodation whilst at resort, you must inform the accommodation provider immediately.

Only in the event that the matter was not rectified sufficiently within 24 hours you must call Benitravel on the emergency contact number upon your voucher immediately in order to give us the opportunity to resolve the problem.
